My understanding is that the town is looking at a grant in the amount of 200K. If the land purchase is 600K, what are the costs in the proposals the town received to construct a launch ramp, parking lot, recreation area, walking paths throughout mud cove and three observation decks and a self composting toilet? Will open space funds be used for that too?

Has anyone looked at getting a right of way from the federal gov't through Ninigret Park for a boat ramp? Or buying that thin strip of land inbetween where our land ends and the pond? We both agree that $600,000 is alot of money- your reasoning is correct!

I can tell you without a doubt that this last minute push to establish water access is based more on the perceived use of "free" grant money from the state and not on a proper and thoughtful study of the proposed area. Mud Cove is appropriately named. At low tide the depth of the cove is ZERO! At high tide you might see 12-18" of water, the coastal area surrounding the cove is marsh and swamp with land that will not support the weight of an adult unless frozen solid in the winter months. This area is full of wildlife; families of fox, rabbit, and deer are frequently scene in the area as well as Egret, geese, and other water fowl.
We have identified the additional burden to the community such as increased police and water law enforcement presence, maintenance of additional structures, Trash and rubbish removal, displacement/relocation of impacted wildlife, etc. These are actual life-cycle costs that must be financed by the tax payers. From all documentation we have been able to collect, the (Town) has not addressed and identified the additional burdens to the taxpayer for this proposed project.

If the land didn't sell in 2005, 06, and 07 during the height of the economy, record S&P 500 levels, and the peak of bank leveraging, why on earth would in sell today for $800,000 in one of the worst economic downturns since the Great Depression. It is not an approved building lot, rendering its value in its current state next to nothing.

it seems like Forrester Safford is really trying to push this project through as fast as possible without public knowledge, without doing homework on the value of the Maynard Property, and without a true, realistic plan in place. Is this how the Town Council usually operates or does he have a undisclosed relationship with the owner of the land, Ken Maynard?..or another party looking to benefit?? It just seems he is too eager to pay top dollar for this land and is looking to increase the valuation, rather than negotiate on behalf of the town.

It seems no matter who sits on the council, they lose the fact that WE put them there to represent US properly and to LISTEN to us.

Can anyone be elected?
This is just so frustrating. It is typical big city government in our beautiful small town. What gets into them? Do they think they are all little mayors? Is it getting to their heads? Do they think they are now more important than the actual people who put them there?

I had voted for this group of Town Councilors in the hope of bring sanity to town government. Between the proposed "Mid Cove" project and the proposed unrealistic Wind Energy ordnances. Add another $30,000 plus to the Mud Cove project for a Septic System that the average citizen can absorb, and what ever happen you to the advice provide by the profession engineers who have built and operated Wind Energy Systems. I wonder where reason has gone.

As if the driving range isn't a big enough joke at the expense of the tax payers, how could anyone in their right mind support " Mud Cove". Not to even consider the environmental impact to the pond why should we the tax payers of Charlestown encourage any more out of towners to just " drop and go " without bringing any significant economic boost to the area.
We don't even have a decent boat launch for the residents, as a resident I probably would have to camp outside the gate to get a parking spot not to mention fighting with " tourists " to launch and haul.
Charlestown for the people that live here, build a decent ramp and issue a resident sticker with a minimum of 50% of the parking for residents only.

What do you guys know about the Mud Cove Project on Ninigret Pond? It looks like there will be a boat ramp, parking lot, playground and walking trails (no bike trail along route 1) which encourages car access to the pond. What is this all about, with Ninigret Park less than 1/2 mile away? Doesn't this further threaten open space, conservation, in a sensitive environment? How is this good for the town?

It is very shallow in front of this property. At times it is less than 6 inches. I would imagine a big dredging project would have to take place. As we said before this area is home to many native shell fish.

I suspect that this is a controversial topic, however if we are on a topic concerning Ninigret Pond and spending money there, it might be a good time to visit the overall condition and health of the Charlestown breech way and the pond. The breech way is one of the largest and most popular attractions this town has. It was built in 1952 and to date has not received any maintenance since that time; either from the town or the state. The Charlestown breech way walls are falling in, and essentially are falling apart. The fallen rocks now present a hazard to the people who walk on the walls and to vessels using the breech way to go to and from the ocean. The Charlestown breech way is one of the town’s most precious resources, yet it is ignored and seems to have been forgotten. Its presence seems to be taken for granted. From the breech way itself once a boater is inside of the pond the channel is just about nonexistent and is primarily filled in, to the point where many boaters are moving their boats to other estuaries due to the damage to their motors, hulls and due to getting stuck in low-water conditions. I suspect that some may not be too concerned about the recreational boating factor, however many of these recreational boaters have homes in the area and pay taxes; high taxes if they are on the water. The recreational boating industry makes a positive financial impact on all local businesses, from the marinas, to the local markets and restaurants, and essentially every business in the area. If the town is considering spending close to one-million dollars on something, perhaps those monies would be better spent repairing this valuable resource before it is lost through attrition.

At the council meeting last week Rich Hosp made the distinction between the Mud Cove Project and the Boat Launch. He said they looked like two separate projects to him and he wondered if they could be treated separately. I am not sure how CCA feels about this, but I do not worry so much about the selective clearing of invasives and development of a trail and observation platform or two in the original parcel as I do about the boat launch and purchase of this outrageously priced bit of property. I hate to see the baby thrown out with the bathwater. Can CCA address them as two different projects?

the area in front of Maynard's property is very shallow. We actually walk through this area when we go clamming. Its approx. 8 inches deep until you get about 20 yards out. Then the depth changes gradually to about 24-28inches.

Looks like a multi million dollar venture that has not been thought out too well. If demand is so high for more boat launching capacity why not improve the other 4 boat launch areas. Where is the study that says demand for launch areas is so tremendous we need to do this. Why this lot. Why the price? What good is it in shallow water? Does it make money for the town? Or is it a cost center that will continue on forever as dredging is required. I think the town counsel could spend their time and my money better elsewhere!

I’ve been in Charlestown for decades—didn’t Forrester run into trouble previously as a Town Council for unethical behavior with the Attorney General’s office? It’s so blatant what he is doing. He’s a builder. Does he also have a relationship with Ken Maynard in any way. And Charlene Dunn—shame on her. Her reputation is totally tainted now. She walks lock step with Forrester. I’m wondering what her colleagues think of this up at URI where she works—do they trust her? And this town manager—he’s in cahoots with Dunn and Forrester. He’s their lackey doing their bidding. Another interesting point is the fact that the state could not come up with $ 187,000 in funds to support the Army Corp of Engineers project to remove the hazardous rock structure at the mouth of Charlestown Breachway but they have $200,000 to support this waste of our money.

Your statement regarding " public launch ramps " on Ninigret Pond is misleading, yes they are open to the public but 3 of the 6 are owned and operated by marinas on a cash for splash, the ramp at the breachway is a joke ( pay for a sticker from DEM for access ).
The town right of way/launch on the "Green Hill Cut" is not a real ramp. The Ninigret Park launch is access for canoes and kayaks, the town dock is canoe/kayaks with minimal parking.
A ramp/launch is a real ramp that you can easily and safely back a trailer down, have a reasonable water depth for your boat at all tides and have a secure place to park your vehicle and trailer.
I would rather pay a marina launch fee than support yet another town sponsored scam such as the driving range !!
I'm sure that along with this "Maynard Property" proposal would also at some point include some town employees to collect fees ( ? ) and maintain the facility.

I also would like to know what we, as taxpayers, can do to stop this atrocity. This project is wrong on so many fronts. Ninigret Pond and it’s ecosystems are already delicate and I would think that the Charlestown Council would be aware of this. By allowing something as irresponsible as this project to go forth before the DEM is only opening the floodgates for all those unbuildable water front properties to follow suit ultimately destroying one of Charlestown crown jewels – Ninigret Pond! The fact that Council Members Forrester Safford and Charlene Dunn (both members of the council) were previously involved (working together with) Kenneth Maynard (the property owner) in a legal issue against the town of Charlestown regarding water front properties and their values is at the very least suspect. (Has anyone checked the deed of Mayard’s property to see if there are any other names on it?) It is my opinion that we need to find out and publish somehow what we or anyone can do in a proactive manner to stop this nonsense before it gets any further. I’m assuming that at some point this must go before a town vote. If so, maybe we should start by taking out more advertisements in local newspapers encouraging all to vote or contact the environmental writers at the Providence Journal to see if they would be interested in covering this story. Maybe another option would be to get the Salt Pond Coalition or Save the Bay involved. Is there anything we can do proactively to prevent this?

Please check out the Westerly Sun article today titled “Land Trust secures another 306 acres”. This is vital land/wetland to help secure water quality, air quality and open space for Westerly. All this for $560,000 per the Westerly Sun. What are the Town Councilors of Charlestown thinking? Charlestown has at least one large parcel of important habitat (greater than 50 acres) that could be bought today for less than $200K! I am disappointed and entirely surprised that this tiny parcel would even be considered for purchase by our town. Why didn’t the Town Councilors discuss this move with the Conservation Commission or the Planning Commission OR the South County Conservancy? I know what will be transparent next November-each of their seats on the TC!!

Went to the town hall today to try and pull the full appraisal on the Maynard lot. I found that William Di Libero has pulled the appraisal out of the files and will not release it to the pubic. Is this legal? His reason is that the town is negotiating a purchase. It seems odd that he doesn't want the public to examine the appraisal. Our argument is the value is too high, wouldn't that help the town in its negotiation? The behavior of the town administrator and town council could expose Charlestown to legal liability.

The Land Appraisal is a public record and thus falls within the parameters of the Freedom of Information Act. Google the act if you would like to know more! If there was a court action of law suit involving this property or the appraisal, it "may" be exempt from the act, however this does not appear to be the case. Plus if this appraisal has been part of the forum for a "public" town council meeting, it certainly is a public record and has to be made available to the public. Beside all of that there is a question of who paid for the appraisal, if town taxpayers money paid for, we are entitled to see the document.

The appraisal for the lot should be able to be found on the website of the firm who last did the appraisals for the whole town of Charlestown. I can not think of the name of the firm but the Town Hall should be able to tell you. You will be able to compare all parcel appraisals in the town of Charlestown on their website.

In response to your latest e-mail - You quote Mr. DiLibero as saying "The appraiser was aware of the easement on the property." They were.
They had been informed, however, that Ken Maynard's attorney, Mr. Mark. Russo, was "in the process of contacting and negotiating with the abutting owner." "...in hopes of upgrading their system to an advanced treatment system which would eliminate the need for the existing leachfield easement...." *
The abutting owner stated at the last council meeting that no such discussions had taken place and that he had not been contacted by Mr. Russo nor anyone else.
In addition, the town stated repeatedly that all permits for the property had been issued. CRMC permits had been sought on several occasions, but were never issued.
Therefore, two critical pieces of misinformation contributed substantially to the appraised value of this piece of property.
If we remove all of the other concerns over the wisdom of this project, we are still confronted with the question as to why the council insists on relying on this flawed appraisal of $666,000 for 1/2 acre of constrained property. In the interest of the citizens wouldn't the council jump at the chance to purchase this lot for the least amount possible?

Can't we get away from the political rhetoric and ask the Town Council three(3) questions:
1. Why does the town need a boat launch when there are three(3) public launches on Ninigret Pond?
2. What grievous and irretrievable harm will be done to the Town or the Pond if we do not go forward with this purchase?
3. In this economy, is this the best use of $600,000 of public funds?

While the value of the property is certainly a major question , there are certainly enough negative secondary points to really question whether the project has merit. Does the project really benefit the town from a financial point of view. Will it upset the environment significantly. Does the planned site really have deep enough water. If not will there be extra costs involved in dredging on a continuous basis. If there are 4 other launch sites in the immediate area is a fifth one needed; or would the town benefit more by improving the other sites with the funds needed to build a new launch site. Is the buying team really negotiating a good price or hardly negotiating. Has the process been above board? If the proposal involves staffing this new site to collect fees and monitor activity, have these additional costs to the town been taken into consideration. On a more basic level, with limited funds available for town projects are there better projects for the town to spent their limited dollars on.

Seems to me that there are two appraisals, both over 600k, and you stated in your last email blast that "we are not real estate experts." Therefore, instead of clouding the issue by complaining about the valuation of this property, why don't you call for an independent appraisal. The problem is, who will pay for the appraisal. If the town pays for it, you will claim the numbers are falsified to support the town. If you pay for it, the town councilors can claim the same thing. Facts are needed here - not speculation. Without an independent appraisal that rebuts the two existing appraisals, I'm afraid that, like it or not, you'll have to live with the results of those two appraisals.

Citizens of Charlestown:
Mr. DiLibero is only half-correct in asserting his rights under the Access To Public Records Act regarding the appraisal of the property being used in the boat ramp. The information doesn't become public until either "the property has been acquired, or all proceedings have been terminated or abandoned". If it's true that he's throwing in the towel, then thethe appraisal is now public record.
The section of law he is referring to can be found in RIGL 38-2-2 (N):
"The contents of real estate appraisals, engineering, or feasibility estimates and evaluations made for or by an agency relative to the acquisition of property or to prospective public supply and construction contracts, until such time as all of the property has been acquired or all proceedings or transactions have been terminated or abandoned; provided the law of eminent domain shall not be affected by this provision."
If the project has been abandoned and DiLibero still refuses to show the appraisal, then you need to submit a written request to him asking for it (you may want to insert paragraph (N) above into your letter), and then he has up to 10 days to respond to your written request with either a copy of the appraisal or a written denial, stating the reasons why you are not entitled to it, along with your rights and procedures to appeal to the AGs office. If he does not respond within 10 days of your written request, then 38-2-7 (b) presumes it to be a denial by default.
However, note that he has "up to 10 days" to provide you with a response. If the AGs office determines that this record was "readily available" under RIGL 38-2-3 (c), then DiLibero or his staff must hand them to you over the counter and not require you to make a written request. If anyone in the town offices asks you the reason you are seeking the records, you do not have to answer that question under 38-2-3 (h).
Also, make your initial APRA request directly to DiLibero and not someone below his rank, because your appeals process will require you to re-file your written request with the town's highest ranking executive under 38-2-8 (a) prior to going to the AGs office.
Once you've exhausted all of the above, send copies of your requests and his response, along with a letter of complaint to:

And... if we are on the topic of high-cost programs, how about we talk about putting in a boat launch ramp that abuts a non-profitable driving range (that the town owns) where one can launch a boat into about ten inches of water (on a good day), that will be in competition with several local town businesses--who too are feeling the pinch of the economic conditions--so someone can satisfy who knows what and at what expense!!!!????? Lets talk about maintainance, rubbish removal, policing, an attendant being present during launch times, insurance for the ramp and then the eventual cost for dredging for navigational purposes, just to name a few expenses!! With that in mind the cost effectiveness of a municipal court looks like a walk in the park compared to that political boondoggle!!!

For the life of me, I can't imagine why we should destroy any more of this very fragile ecosystem.
Why can't people who want to kayak/observe the Pond~continue do so from the East Beach?
The ONLY part of this proposal that I agree with is a handicapped accesssible ramp to see Ninigret Pond.
But that would seem much, much less invasive if it were just added at East Beach.
Why destroy anymore of this already stressed environment?

How could anyone possibly consider doing any further damage to this extremely fragile ecosystem on Ninigret Pond?
I kayaked into Mud Cove once in high tide, and was stuck in the "muck" for almost any hour.
ANY DREDGING HERE WILL PERMANENTLY DESTROY THE POND~ LEAVE IT ALONE!
It will be the beginning of the end of the of the pond/barrier beach.
There are already plenty of areas on Ninigret Pond for the public to enjoy!
Going forward with ANY part of this plan will only be more needless destruction~ of already declining wildlife.
Haven't we as human beings done enough damage ALREADY?
Speak up and JUST SAY NO!
